Deborah Bush of EPP Coaching and Consulting (the “Developer”) and its affiliates and partners provide an online learning platform on https://www.periodhealth.nz, (the “Online Resource“) that can be used by schools/organisations, teachers/trainers, students/learners and their parents, (collectively, the “Users“).
These Terms of Use are entered into by and between you as a User and the Developer, and together with the Privacy Policy, govern your access to the Online Resource and its content and functionality.
Your use of the Online Resource, and its content, constitutes your agreement to be bound by these Terms of Use. The offering of the Online Resource to you is conditional on your acceptance of these Terms of Use. If you do not agree to these Terms of Use, you must not access or use the Online Resource.
- Availability and accuracy of information
- All care has been taken to ensure the information in the Online Resource is accurate and that it is consistent with current literature, clinical guidelines and the New Zealand school curriculum. Please remember that information relating to endometriosis is constantly being updated by clinicians and the research community. The Online Resource is not intended to replace medical or professional advice. Always consult with your healthcare professionals about symptoms, questions or concerns you may have.
- The Developer excludes all legal liability arising from or connected to, the accuracy or completeness of any content or information contained in the Online Resource, including but not limited to any reliance placed on the content or information contained in the Online Resource for any reason whatsoever.
- The Developer reserves the right to update the information on the Online Resource from time to time.
- Intellectual Property
- All intellectual property in the Online Resource, including without limitation, the text, graphics, photographs, logos, icons, buttons, images, copyright works and trade marks, is owned by the Developer (or by third party content suppliers). For the avoidance of doubt, the me® logo must not be reproduced or used in any way unless with the prior written consent of the Developer.
The Developer is the exclusive owner of all rights in the compilation, design and layout of the Online Resource.
- Rights to Use the Online Resource and Content
- The Developer grants each User a limited, non‐exclusive, non-sublicensable and non-transferable license to access and use the Online Resource for their own informational and other non-commercial purposes, subject to the following conditions:
- Users may only view, copy, and print such portions of the Online Resource for their own personal, informational or educational use only, and may not copy or distribute any Online Resource content to any other person or for commercial use without the prior written consent of the Developer;
- Users may not modify or otherwise make derivative works of the Online Resource, or reproduce, distribute, or display the Online Resource content except without the prior written consent of the Developer;
- Users may not remove or modify any copyright, trade mark, or other proprietary notices that have been placed in the Online Resource;
- Users may not use any data mining, robots, or similar data gathering or extraction methods; and
- Users may not use the Online Resource other than laid out in these Terms of Use.
- The Developer reserves the right to prohibit links to the Online Resource, and Users agree to remove or cease any link upon the Developer’s request.
- The Developer grants each User a limited, non‐exclusive, non-sublicensable and non-transferable license to access and use the Online Resource for their own informational and other non-commercial purposes, subject to the following conditions:
- External website links
- The Online Resource may contain links to third party websites. These websites have not been prepared by the Developer and are not controlled by the Developer. They are provided for Users convenience only, and do not imply that the Developer checks, endorses, approves or agrees with third party websites or products and services that the Online Resource links to.
- Disclaimers and limits of liability
- To the fullest extent permissible by applicable local laws, the Developer, its subcontractors and collaborators exclude all liability:
- arising from or connected to the accuracy or completeness of any content contained in the Online Resource;
- for damages and direct, indirect or consequential loss incurred by Users or any third party and arising out of or in any way connected with the use of or reliance on the information provided in the Online Resource (including any health specific information);
- for any damages and direct, indirect or consequential loss caused by viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to Users use of the Online Resource or downloading of any material posted on the Online Resource or on any sites linked to on the Online Resource.
- The Developer will make reasonable efforts to ensure that the Online Resource is available to Users. However, access to the Online Resource may be disrupted from time to time due to necessary maintenance, technical issues or events outside of the Developer’s control. The Developer will use commercially reasonable efforts to avoid downtime of the Online Resource during peak hours, but assumes no liability if the Online Resource is unavailable at any time or for any period.
- To the fullest extent permissible by applicable local laws, the Developer, its subcontractors and collaborators exclude all liability:
- General Provisions
- Privacy: The Developer will only use User’s personal information as set out in the Privacy Policy, as amended from time to time.
- Validity: If any provision of these Terms of Use is deemed unlawful, void, or unenforceable, that provision shall be deemed severed from the remaining provisions and shall not affect their validity and enforceability.
- Governing Law and Jurisdiction: Except to the extent required by mandatory local laws, these Terms of Use are governed by New Zealand law. Users hereby agree to submit to the jurisdiction of the Courts of New Zealand in respect of any disputes in relation to these Terms of Use, except where the courts of another country would have jurisdiction in accordance with mandatory local laws.

What about me® and the Developer (referred to in this privacy policy as “we”, “our” or “us”) is committed to safeguarding the privacy of individuals who visit the Online Resource. We understand that personal information should be kept private.
The purpose of this privacy policy (“Privacy Policy”) is to inform Users (referred to in this Privacy Policy as “you” or “your”) as to how and why we might collect, store, use and/or share your information when you use the Online Resource.

- What information do we collect?
- We collect any personal information that you provide to us, such as when you express an interest in obtaining information about us or our services, or otherwise when you contact us using the “Contact Us” function on the website.
- We automatically collect certain information when you visit, use or navigate the Online Resource. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your Internet Protocol (IP) address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use the Online Resource, and other technical information.
- This information is primarily needed to maintain the security and operation of the Online Resource, and for our internal analytics and reporting purposes.
- Like many businesses, we also collect information through cookies and similar technologies, such as log and usage data, device data, and location data.
- How do we process your information?
- We process your personal information to provide, improve, and administer the Online Resource, to identify usage trends, and for security and fraud prevention.
- When and with whom do we share your personal information?
- We may share your data with third-party service providers, contractors or agents (“third parties”) who perform services for us for on our behalf and require access to such information to do that work. We have contracts in place with our third parties which are designed to help safeguard your personal information. This means they cannot do anything with your personal information unless we have instructed them to do it and cannot share your personal information with any organisation apart from us.
- We may also need to use your personal information to protect ourselves from criminals or fraudsters and in some circumstances, we may also need to share or use your personal information to make sure that we follow the law.
- We may also use or transfer your personal information to a successor entity in the event that we sell or transfer the Online Resource and we will endeavour to ensure that the successor entity applies this policy to such information.
- We will keep your personal information safe and will not give it to any third party except as explained in this Privacy Policy or where we are allowed to do so by law.
- Do we use cookies ?
- In order to collect some of the data described at clause 1, we may use cookie technology on the website which houses the Online Resource. A cookie is a small piece of information which is sent to your browser and stored on your computer’s hard drive, mobile phone or other device. Cookies do not damage your computer.
- You can set your browser to notify you when you receive a cookie. This enables you to decide if you want to accept it or not. However, some of the Online Resource may not function properly if your cookies are disabled. We use cookies that are necessary for the performance of the Online Resource and cookies that do not personally identify you, but may be used for analytics purposes, such as allowing us to see how many people use and access our website so that we can improve our services.

- We take reasonable measures to ensure the security of your personal information that is held by us from such risks as loss, misuse, unauthorised access, disclosure, alteration and destruction. However, if you send information to the Online Resource, we remind you that the Internet is not a secure environment and although all reasonable care is taken, we cannot warrant or guarantee the security of information you provide to us via electronic means.
- For how long do we hold personal information?
- We will keep your personal information for only as long as is necessary to achieve the purpose for which we collected it. In most cases this may not be longer than 2 years.
